Mr Nathwani has experience in all hearings undertaken at the Crown Court as well as appearing before the Court of Appeal. In his first year in he was a led Junior in a case involving a multi-million pound drug importation. His practice includes serious sexual assaults, possession of firearms, drugs, fraud, assaults and roberries, public order and dishonesty cases. He also has experience of cases involving Defendants with Mental Health difficulties.
Additionally, he has appeared in Extradition hearings for requested persons, at Court Martials and at Prison Adjudications.
Mr Nathwani also has frequently acted in Council led regulatory matters, including HMOs, Buildings Regulations, Trading Standards (including Heath and Safety) and under the Consumer Protection Act.
Prior to being called to the Bar, Mr Nathwani was employed as an accredited police station advisor, whilst working for a leading firm of Solicitors in London.
Recent Notable Cases:
R v Taylor (2011) (Blackfriars Crown Court) 9 handed football violence trial involving Tottenham and Portsmouth supporters at King Cross station after FA Cup semi-final in 2010. After 4 week trial, one of four acquitted by the jury.
R v Economides (2011) (St Albans Crown Court). Representing an accountant accused of stealing £60k from his employers and subsequently manipulating the accounting records. Defendant had 2 previous convictions relating to identical offences. Acquitted of £58k of the allegation.
R v D (2011) (Croydon Crown Court) Led Junior (by Paul Walker). This case involved multiple rapes and sexual assaults within a learning disability community against 4 separate complainants. All the complainants had severe learning difficulties with one having Downs Syndrome. As a result, intermediaries were used. The Defendant also had learning difficulties as well as non-conviction bad character history of repeated serious sexual assaults over decades. Complex bad character and cross-admissibility arguments followed. After a 4 week trial, Defendant acquitted of the vast majority of counts.
R v Thompson (2010-1) (Inner London Crown Court). Lead trial of 7 as part of Operation Balconi into organised football violence. This trial related to planned football violence between Tottenham Hotspur & West Ham fans. First trial had 7 Defendants indicted, including the main organisers. After 6 week trial, represented the only Defendant to be acquitted.
R -v- Sedikki (2010) (Isleworth Crown Court) Junior alone. Possession of Firearms. Successfully argued “exceptional circumstances” not to impose minimum 5 year sentence; 2 ½ years imprisonment imposed.
R -v- M (2010) (Croydon Crown Court). Junior alone. Rape.
R -v- Shala (2010) (Court of Appeal) Appeal against sentence in relation to blackmail offences
R -v- B & Ors (2009) (Snaresbrook Crown Court) – Junior alone successfully representing a 12 year old Defendant in a multi-handed affray and ABH trial
R -v- Hamilton (2009) (Southwark Crown Court) – Junior alone in a multi-handed conspiracy to commit fraud by false representation (total value over £200k)
R -v- Richardson (2008) (Kingston Crown Court) Led junior for the main defendant in a multi-handed large scale fraud, involving money laundering and POCA/DTA offences.
R -v- Foreman (2008) (Snaresbrook Crown Court) Led Junior in a case involving multiple rape allegations. This case was complicated by legal argument relating to both cross-admissibility of evidence in relation to the various counts and also the admissibility of previous acquittals as bad character evidence.
