R v. McDermott & ors [2011]
Case involving the Possession of Drugs with intent to supply and Firearms with intent to endanger life. Operation Trident case, intelligence led, involving covert surveillance. Mr Martin acted for a defendant who along with along with others, was said to have travelled to Preston as part of a group to support a fellow gang member on trial in that City. They had taken a loaded firearm with them for protection. During that time there was an altercation with a rival gang where the gun was produced.Police had been monitoring events during their stay in the Preston area and the car they were in was stopped by Armed police when it arrived back in London. Mr Martin’s client was acquitted at the close of the Crown’s case following a successful submission of No Case to Answer in relation to the concept of joint possession of a firearm in the car which had three occupants.
