Successful wasted costs application

Elena Colato was instructed to represent a man charged with assault and criminal damage, in a domestic setting.

Following her client’s acquittal, Elena pursued a wasted costs application pursuant to s.19 Prosecution of Offences Act 1985. The application was made on the basis that the Crown’s disclosure failings had caused the defendant to incur significant costs.

The Court found that the conduct of the Crown was improper and that the costs sought were proportionate and reasonable. The sum sought was awarded in full.
